Carriere stroncate, vite distrutte senza che nessuno ne paghi le conseguenze tantomeno in termini disciplinari. E' anche la ragione per la quale riteniamo che sia arrivato il momento per accelerare i tempi in Parlamento per la approvazione della legge sulla separazione delle carriere e la riforma del Csm". Lo dichiara a Tgcom il deputato di Forza Italia e vicepresidente della commissione Giustizia alla Camera, Pietro Pittalis. Quanto alla abolizione del reato di abuso di ufficio, Pittalis ricorda che "ha subito una serie di modifiche dal 1990 fino al 2020 nel tentativo di precisare i connotati della condotta punibile ma senza conseguire gli obiettivi prefissati, spesso per responsabilità della magistratura che ha sempre trovato il modo di vanificare gli sforzi del legislatore riallargando i margini applicativi della fattispecie. E' una norma incriminatrice desueta e dannosa, percepita dagli amministratori e dai funzionari pubblici come la causa di una esposizione ad un rischio elevato di responsabilità penale. Pensando ai danni prodotti dal solo avvio delle indagini, determinando la paralisi dell'azione amministrativa in un momento storico in cui occorre portare a compimento le opere pubbliche legate al Pnrr, rappresenta un ostacolo alla ripresa del Paese con un costo di circa il 2% del Pil"."I numeri confermano che è una norma desueta e dannosa poiché, a fronte di un numero di iscrizioni nel registro degli indagati, solo una esiguità di queste si trasforma in sentenze di condanna. Per questa ragione la maggioranza - prosegue l'esponente azzurro - ha ritenuto di abolire un reato che non ha nessuna necessità in un sistema e che crea solo un sovraccarico di lavoro alle procure della Repubblica. Le modifiche non hanno avuto alcun effetto anzi, abbiamo assistito a una giurisprudenza creativa che si è ancorata ai principi di ordine generale stabiliti dall'art. 97 della Costituzione. E' inammissibile continuare ad alimentare un sistema che ha determinato la paura della firma anche perché si è trattato di un reato utilizzato dalla magistratura requirente come una sorta di grimaldello per ingerirsi nell'attività della pubblica amministrazione.
