Il giudice, però, ha escluso il reato di strage confermando tutti gli altri. Si tratta del 18enne Salvatore D’Acunzo, legato da vincoli di parentela al clan Gionta.Secondo la ricostruzione delle forze dell'ordine l'indagato è entrato in azione con un complice non ancora identificato, armati di una pistola e di un fucile, e avrebbe aperto il fuoco nei confronti di una persona che si trovava nel mezzo di una folla di bagnanti - mettendo in pericolo così la pubblica incolumità- mentre la vittima designata riusciva a scappare ed a mettersi in salvo. L'azione sarebbe stata preordinata ed organizzata per punire la vittima a causa di uno sguardo di sfida che avrebbe rivolto all'aggressore.Le ragioni presumibilmente sottese all'agguato ed uno degli autori dello stesso venivano individuati grazie a diverse attività tecniche già in essere da parte dei Carabinieri del Nucleo Investigativo di Torre Annunziata ed ai successivi accertamenti svolti, nell'immediatezza dei fatti, da personale della Squadra Mobile di Napoli e del Commissariato di Torre Annunziata.
