a Torre del Greco (Napoli), ed esposto all'amianto per oltre quarant'anni (dal 1961 al 2003), ha diritto sia al prepensionamento che alla rivalutazione della pensione. A stabilirlo, il Tribunale di Torre Annunziata (Napoli) che ha condannato Inps a concedere al lavoratore i benefici spettanti con una maggiorazione della pensione di 500 euro mensili, oltre a una rivalutazione e liquidazione per gli ultimi 10 anni.Raia nel 2019 si era ammalato di "ispessimenti pleurici", patologia asbesto correlata accertata dall'Inail, era stato esposto a fibre e polveri di amianto sia durante le attività di imbarco sulle unità navali della Marina mercantile, sia prestando servizio come dipendente al servizio di Costa Armatori spa. Nello specifico aveva svolto mansioni di operaio, prima motorista, poi meccanico e successivamente tornitore. Attività che determinavano una esposizione diretta e indiretta, dal momento che gli ambienti erano contaminati dalle polveri e dai rivestimenti che si aerodisperdevano. L'amianto era addirittura presente anche nella cabina che lo ospitava e nei dispositivi di protezione individuale (Dpi) per proteggersi dall'elevato calore. L'ex dipendente aveva pertanto chiesto l'adeguamento dei ratei della pensione e relativa ricostituzione della posizione contributiva, richieste che l'Inps aveva negato. L'uomo ha finalmente ottenuto giustizia grazie al ricorso dell'avvocato Ezio Bonanni, presidente dell'Osservatorio nazionale Amianto, al Tribunale di Torre Annunziata, che sottolinea: "questa sentenza rappresenta un importante punto di partenza per un cambiamento tangibile nella cultura della sicurezza del lavoro, affinchè nessun altro lavoratore debba lottare per ottenere i propri diritti fondamentali".
